PROMOTION: Surprise and Delight Gift Cards

1. The following terms and conditions (“Terms“) apply where you redeem and/or use a Surprise and Delight Gift Card (“Gift Card“).
2. By redeeming and/or using a Gift Card you agree to these Terms.
3. In addition to these Terms, you should also refer to the participating retailers’ general terms and conditions.

Surprise and Delight Gift Cards

1. The “Promoter” of this promotion is Sylvia Park Business Centre Limited, Level 7 Vero Centre, 48 Shortland St, Auckland, 1010.
2. The promotion shall run from 9:00am, 27 November 2023 to 9:00pm, 15 December 2023 but may finish earlier in the Promoter’s sole discretion.
3. This Promotion will take place at the shopping centre otherwise known as ‘Sylvia Park’ only.
4. Entry into this promotion is only open to New Zealand residents who are aged 16 years and over.
5. A person qualifies to enter this promotion if:
   1. A winning ticket is placed on their vehicle; or
   2. They receive a winning ticket from a Christmas elve at Sylvia Park.
6. A person can only participate in the promotion once. All decisions made by the promoter are final and no correspondence will be entered into.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and reserves the right, in its sole discretion, to disqualify any individual who the promoter has reason to believe has breached any of these Terms, tampered with the process or engaged in any unlawful or other improper misconduct to jeopardise the fair and proper conduct of the promotion.
8. Persons excluded from entering this promotion are staff and contractors of the Promoter, any participating sponsors, retailers and staff members from any participating centre of the Promoter and their associated agencies and companies.
9. Once a recipient has received a winner’s ticket, the recipient shall take it to the customer service desk at Sylvia Park to have it validated and redeem a Gift Card.
10. A Gift Card can be redeemed by providing the Promoter with the recipient’s personal details (being their first name, last name, email address, date of birth and suburb of residence) as well as the winner’s ticket in exchange for a physical Gift Card.
11. A winner’s ticket must be exchanged for a physical Gift Card within seven (7) days of the date stated on the winner’s ticket. If the winner’s ticket is not exchanged for a physical Gift Card by that date, the winner’s ticket will no longer be valid and the value of the winner’s ticket will be forfeited to the Promoter.
12. Only the person who provides the Promoter with the winner’s ticket will receive the Gift Card.
13. Promotion prizes will be available while stocks last and on a first-in, first-served basis. No holds will be permitted.
14. The Promoter takes no responsibility if the winner’s ticket is obtained and used by the wrong person, or where the winner’s ticket is lost or stolen.
15. Gift Cards are redeemable for merchandise and/or services sold at those participating retailers within Sylvia Park as further set out below.
16. Gift Cards may not be used for any other purpose. Purchase with a Gift Card is as if the purchase was made by way of cash payment. Gift Cards may not be redeemed or exchanged for cash.  They are not legal tender, account cards, credit or debit cards or securities.
17. All Gift Card’s will expire at 7pm on December 24, 2023. After expiry, the Gift Card will no longer be valid and any balance left on the Gift Card will be forfeited to the Promoter without compensation.
18. Lost or stolen Gift Cards will not be replaced. Gift Cards should be held in a secure place, as any person holding the Gift Card may be able to use it before the expiry date.
19. Any failure by a recipient to comply with the Terms may result in the Gift Card being cancelled or withdrawn without liability for the Promoter.
20. Gift Cards will be void and will not be redeemable if they are defaced, mutilated, altered or tampered with in any way.
21. Gift cards issued by the Promoter are intended for one-time use only.
22. If the full value of the Gift Card is not utilised in a single transaction, the remaining balance cannot be carried forward or redeemed in subsequent transactions and will be forfeited to the Promoter without compensation.
23. Gift cards cannot be loaded with additional funds and once the Gift Card is used (in full or part) it must be surrendered to the participating retailer.
24. The Promoter is not a party to any purchase contract using the Gift Card and are not liable for and make no warranty regarding the availability, quality or fitness for purpose of any goods or services purchased with the Gift Card. If you have a dispute about the goods or services, you must resolve the dispute with the retailer where you purchased them.
25. If you wish to return goods to the retailer you purchased them from with your Gift Card, it is not possible to reimburse funds on to the Gift Card. The retailer will need to provide a credit, subject to their terms and conditions.
26. The bearer of a Gift Card cannot consolidate the balances of several Gift Cards onto a new Gift Card.
27. The Promoter reserves the right to cancel this promotion and/or any Gift Card for any reason at any time without notice. If this occurs, the balance on all valid Gift Cards will be forfeited to the Promoter without compensation.
28. Each recipient must take part in all reasonable publicity, photography and other promotional activity as the Promoter requires, without compensation. Each recipient consents to the Promoter using their names and images in any promotional or advertising activity related to the promotion (without any royalty, commission, fee or compensation being payable by the Promoter to the recipient in connection with any such use).
29. The Promoter reserves the right to vary any of the Terms or to modify, terminate, suspend or reschedule this promotion at any time.
30. Your Gift Card may not be copied or reproduced in any circumstances.
31. Details on what information the Promoter collects and how they use it is set out in the privacy policy found at Privacy Policy » Kiwi Property. By providing the Promoter with your information as part of this promotion you agree to the Promoter’s privacy policy. Any entrant has the right to access their personal information and request correction of any errors in it pursuant to the Privacy Act 2020 by emailing update@kp.co.nz.
32. The Promoter shall not be liable for any loss, damage or personal injury (including but not limited to indirect or consequential loss) suffered by any person arising directly or indirectly out of or in connection with entering this promotion, except as required by law. The Promoter, its partners and providers take no responsibility for any costs or fees incurred by any person as a result of entering this promotion.
33. To the extent that it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, regarding the quality or suitability of any Gift Cards redeemed as part of this promotion and will not be responsible for breach of such representations or warranties.
34. The Promoter may communicate or advertise this promotion using (without limitation) Facebook or Instagram. However, the promotion is in no way endorsed or administered by, or associated with, Facebook or Instagram.
35. By entering this promotion, each recipient consents to receiving communications from the Promoter through the nominated contact details provided by the recipient. These communications include but are not limited to future campaigns, research, marketing of events, offers and surveys.
